Tapatap.com Terms of Service Agreement

This Tapatap.com Terms of Service Agreement ("Agreement") is made by and between Tapatap.com, Inc., a Delaware corporation ("Tapatap.com") and you. By accessing or using any part of this website (the "Site"), any Tapatap.com software, and other services (collectively, "Service"), you agree that you have read and are bound by the terms of this Agreement for all your access and use of the Service. Tapatap.com reserves the right to make changes to any part of this Agreement at any time by posting on the Site a revised Agreement, which shall be effective upon posting. If you use or access the Service after such posting, you are bound by the revised Agreement. Therefore, you should review this Agreement as posted on the Site from time to time. Changes will be indicated by the date at the top of the Agreement.

You shall not use or access the Service or submit any information or material to the Service if you are under 13 years of age. If Tapatap.com believes that certain information was received by someone under 13, it will purge such information from the Service.

Tapatap.com Contest Rules
The Service facilitates the operation of online contests ("Contests") by Tapatap.com, users and Providers. Set forth here (coming soon) are the general terms and conditions ("Tapatap.com Rules") for organizing and participating in a Contest on the Site, which are incorporated into, and subject to this Agreement.

Submission of Content
You hereby grant to Tapatap.com a perpetual, irrevocable, royalty free, worldwide license to use, publicly display, adapt, distribute, copy, cache, transfer, sublicense, make derivative works of, modify and otherwise fully exploit any text, photos, videos, posts, tips, Contest entries, podcasts, audio, graphics, images, or other materials or information that you submit to or through the Service (collectively, "Content") and to publicize your name and likeness. Tapatap.com may do any or all of the foregoing for any purpose relating to its Service, business, products or advertising. Any Content that you submit is non-confidential, and Tapatap.com shall be under no obligation to maintain the confidentiality of any information, in whatever form, contained in the Content.

Without this license, Tapatap.com would be unable to provide the Service. For example, without the right to modify your Content, Tapatap.com would not be able to digitally compress files that you submit or otherwise format Content to satisfy technical requirements, and without the right to publicly perform Content, Tapatap.com could not allow users to view photos posted. The license you grant to Tapatap.com is non-exclusive (meaning you are free to license your Content to anyone else in addition to Tapatap.com), fully-paid and royalty-free (meaning that Tapatap.com is not required to pay you or anyone else for the use on the Service of the Content that you post), sub-licensable (so that Tapatap.com is able to use its affiliates and subcontractors such as Internet content delivery networks to provide the Service), and worldwide (because the Internet and the Service are global in reach).

You shall be solely responsible for the Content and the consequences of posting or publishing it. In connection with the Content, you represent and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize Tapatap.com to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Content to enable inclusion and use of the Content in the manner contemplated by the Site and this Agreement; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Content in the manner contemplated by this Site and this Agreement and (iii) you agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Service. Tapatap.com has the right in its
sole discretion to refuse to post Content for any reason, including, but not limited to, submitted Content that appears to contain material protected by intellectual property rights held by a third party. You agree that Tapatap.com is not responsible for any violations of any intellectual property rights in any Content that you submit to Tapatap.com. You understand that by using this Service, your Content will be publicly available to others and that Tapatap.com has no obligation to prevent the unauthorized copying, dissemination, alternation or other use of your Content by others.

If you want Tapatap.com to remove any of your Content from the Service, you must delete it from the Site. However, we cannot guarantee that your Content will be completely removed from the Service, user devices or user web pages, or that other users will not misuse any Content that you supply. In addition, other users may have already copies and forwarded your Content to others, making recovery impossible.

Notwithstanding anything to the contrary in this Agreement, the operators of public search engines may use spiders to copy materials from the Service for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials.

Password
In order to access some features of the Service, You will have to create an account, with user name and password. You may never use another's account, user name or password without permission. When creating your account, you must provide accurate and complete information and you must update this information to maintain accuracy and completeness. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. Tapatap.com will not be liable for your losses caused by any unauthorized use of your account. You shall be liable for the charges made using your account and any damages incurred by Tapatap.com or others due to any unauthorized use.

Privacy Policy
We take your privacy very seriously and the collection and use of information is governed by our Privacy Policy available at http://www.tapatap.com/privacy_policy.html.

Copyright Policy
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Tapatap.com's copyright agent listed below with the following information required under 17 U.S.C. � 512:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyright work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at the Site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Tapatap.com to locate the material;
  • Information reasonably sufficient to permit Tapatap.com to contact the complaining party, including a name, address, telephone number and, if available, an email address at which the complaining party may be contacted;
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  • A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Use of the Service
Tapatap.com hereby grants you permission to use the Service as set forth in the Agreement, provided that your use of the Service as permitted is solely for your personal, noncommercial use, you comply with the terms and conditions of this Agreement and Tapatap.com's Privacy Policy, including that you shall not, or attempt to, do any of the following (in Tapatap.com's sole determination):

  1. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. harm minors in any way;
  3. impersonate any person or entity, including, but not limited to, a Tapatap.com official, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content submitted to the Site;
  5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as photos of others, inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  6. upload, post, email, transmit or otherwise make available any Content that infringes any privacy, patent, trademark, trade secret, copyright or other proprietary rights of any party;
  7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except that you may provide promotional materials in those areas (such as shopping) that are designated for such purpose;
  8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  9. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Site are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
  10. interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site;
  11. intentionally or unintentionally violate any applicable local, state, national or international law;
  12. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
  13. use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that access the Service in a manner that sends more request messages to the Site's servers than a human can reasonably produce in the same period by using a conventional on-line web browser.
  14. collect or harvest any personally identifiable information, including account names, from the Service, nor to use the communication systems provided by the Service for any commercial solicitation purposes;
  15. "stalk" or otherwise harass another; and/or
  16. collect or store personal data about other users for commercial purposes or in connection with the prohibited conduct and activities set forth in paragraphs 1 through 15 above.
Our Rights
Tapatap.com reserves the right, but is not obligated, to preview or filter Content and reject and/or remove any Content that Tapatap.com believes, in its sole discretion, violate any terms of this Agreement. Tapatap.com may also permanently or temporarily terminate, suspend, or otherwise refuse to permit user�s access to the Service and/or terminate this Agreement, without notice and liability, if, in Tapatap.com's sole determination, user violates any of the Agreement or for any reason. Upon termination of this Agreement, user continues to be bound by this Agreement. At any time Tapatap.com may, without notice, make changes to the Service or products offered thereon.

Notwithstanding anything in this Agreement to the contrary, Tapatap.com reserves the right to take any action required or requested by any carrier, government agency, court, or law enforcement, or in order to comply with any local, state or federal laws, statutes, codes, orders, or regulations, including but not limited to FCC regulations.

Our Intellectual Property Rights
The Service and all materials therein or transferred thereby, including, without limitation, illustrations, logos, photographs, website and wireless design, text, photos, technology, audio, software, photos, logos, video, images, graphics, other content, and the selection and arrangement thereof (collectively "Service Content") of the Service and all rights in the associated intellectual property rights, current or future, including but not limited to, trade secrets, trademarks, copyrights, technology, software rights, service marks, patents, inventions, developments, improvements, mask work rights, moral rights, rights or publicity, trade dress, know-how, and other proprietary rights related to the content of the Site (collectively "Intellectual Property Rights") are the exclusively owned by Tapatap.com or its licensors, and Tapatap.com reserves all rights therein. Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, republish, adapt, edit or create derivative works from, manipulate, edit, posted, transmitted, transferred, use on any other service, website or other networked computer environment, or otherwise exploit in any manner whatsoever without our prior written consent by Tapatap.com. If you download, print, or otherwise reproduce a copy of the Service Content for personal use, you must retain all copyright and other proprietary notices contained therein.

Except as expressly authorized by Tapatap.com, Tapatap.com does not grant, assign, or license you any rights you any right to its Service Content or Intellectual Property Rights and you shall not copy, modify, publish, transmit, distribute, perform, display use, or sell any of Tapatap.com's proprietary information. "Tapatap" and "Tapatap.com" and are trademarks of Tapatap, Inc.

Site Availability
You understand that the Site may be taken down for maintenance from time to time and that most Site features, including access to Contests, will not be available during that time. Tapatap.com shall not be responsible for any connection or access to the Site by you or the quality of the transmission of any information passing between you and the Site. You will be responsible for providing your own communications equipment to access the Site via the Internet, and the Internet access charges thereon.

Termination of Services
You may establish only one account per person, and up to two accounts per computer or address, to participate in the activities offered on the Site. Tapatap.com reserves the right to monitor any effort to establish multiple accounts; in the event Tapatap.com discovers that you have opened more than one account per person, all additional accounts will be closed without notice and continued violation will result in the termination of any and all of your accounts. Tapatap.com also reserves the right to deny access to anyone, including, but not limited to those users who use proxy servers and/or IP addresses residing in certain geographical areas outside of the U.S. Tapatap.com reserves the right to terminate any portion of the Services at any time, for any reason, with or without notice, even though termination may affect your ability to participate or run contests.

Indemnification
You agree to defend, indemnify and hold harmless Tapatap.com and its officers, directors, employees, affiliates, assigns and successors from and against any and all claims, costs, losses, damages, judgments and expenses (including reasonable attorneys' fees) arising out of or in connection with any claim or damages arising from your (or by anyone using your account): (i) use of, or access to, the Service, including any data or Content, Service Content, or other materials transmitted or received by you or through your account; (ii) violation of any term of this Agreement, including without limitation, your breach of any of the representations and warranties; (iii) violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; or (iv) violation of any state or federal law, rule or regulation of the United States or any other country.

Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, TAPATAP.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. TAPATAP.COM MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE. TAPATAP.COM DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND TAPATAP.COM WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. ANY SERVICE CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR WIRELESS DEVICE AND FOR ANY LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD.

TAPATAP.COM IS NOT RESPONSIBLE FOR ANY CONTENT OR THE ACCURACY, USEFULNESS OR SAFETY THEREOF, NO MATTER THE SOURCE. TAPATAP.COM IS NOT OBLIGATED TO REVIEW THE CONTENT FOR ANY REASON. YOU MAY BE EXPOSED TO CONTENT THAT IS INACCURATE, OFFENSIVE, INDECENT, OBJECTIONABLE, INFRINGING, AND YOU HEREBY AGREE TO WAIVE ANY LEGAL RIGHTS AND REMEDIES YOU MAY HAVE AGAINST TAPATAP.COM.

Limitation of Liability
IN NO EVENT SHALL TAPATAP.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY , AND WHETHER OR NOT TAPATAP IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT TAPATAP.COM SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. IN ANY EVENT, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY LIABILITY RELATING TO OR ARISING OUT OF THE SERVICE OR THIS AGREEMENT, REGARDLESS OF THE FORM IN WHICH ANY LEGAL OR EQUITABLE ACTION MAY BE BROUGHT, SHALL BE FOR YOU TO DISCONTINUE YOUR USE OF THE SERVICE AND TERMINATE THIS AGREEMENT.

The Site is controlled and offered by Tapatap.com from its facilities in the U.S. Tapatap.com makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Tapatap.com does not accept responsibility for any charges that may be imposed by your wireless carrier when sending and receiving text messages, WAP push messages or data usage charges while using the Service.

Opt-Out
We may use your information, including but not limited to email address or telephone number, to notify you of important changes to the Service, new contests, and special offers. If You do not want to receive such notices, you may send an email message to optout@tapatap.com with the word "Opt-Out" in the subject field. If Tapatap.com has provided any third party with your personal information, you will have to contact the third-party directly with any opt-out request.

Miscellaneous
This Agreement (including Tapatap.com Rules and Privacy Policy) shall be governed in all respects by the laws of the State of California, without regard to conflict of law provisions. You agree that this Agreement is entered into and to be performed entirely within California. You agree that any claim or dispute you may have against Tapatap.com must be resolved by a court located in San Mateo or Santa Clara County, California. You agree to submit to the personal jurisdiction of the courts located within San Mateo or Santa Clara County, California for the purpose of litigating all such claims or disputes. This Agreement, together with Tapatap.com's Rules and Privacy Policy and any other legal notices published by Tapatap.com on the Service, shall constitute the entire agreement between you and Tapatap.com concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Tapatap.com without restriction or consent. No waiver of any term of this Agreement or delay or failure to enforce a provision of this Agreement shall be deemed a waiver of such term or any other term.

TAPATAP.COM CONTEST RULES

These contest rules ("Tapatap.com Rules") govern all Contests developed by either a user or Tapatap.com. By creating, organizing, participating in, or running a Contest, you agree to be bound by the Terms of Service Agreement, the Official Rules, and these Tapatap.com Rules. Tapatap.com reserves the right to make changes to any part of these Tapatap.com Rules at any time by posting revised Tapatap.com Rules on the Site, which shall be effective upon posting. If you create, organize, participate in, or run a Contest after such posting, you are bound by the revised Tapatap.com Rules. Therefore, you should review these Tapatap.com Rules as posted on the Site from time to time. Changes will be indicated by the date at the bottom of the Tapatap.com Rules.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN ANY CONTEST CONDUCTED THROUGH THE SERVICE.

Organizing and Participating in a Contest:
Any authorized user of the Service may create a Contest. This person is referred to as the "Contest Creator." The Contest Creator is responsible for establishing any "Official Rules" for that Creator's Contest. Such Official Rules shall not conflict with these Tapatap.com Rules. Each Contest Creator hereby represents and warrants that its Official Rules and conduct of each Contest shall be in full compliance with these Tapatap.com Rules. Any authorized user of the Site may submit a photo or image entry ("Entry") in a Contest based on the qualification rules established for the contest. These persons submitting Entries are referred to as "Contestants." Tapatap.com may be the Contest Creator for some Contests, and may have an affiliate who provides prize(s) for the Contest ("Provider"). All Contestants consent to use of name, likeness, entry material in any manner by the Contest Creator, Tapatap.com and/or the Provider or any other Tapatap.com promotional partners for advertising and trade without further compensation, unless prohibited by law. By participating in a Contest, participants agree to be bound by the decisions of the Contest Creator, Tapatap.com or its delegate (including without limitation a Provider), which are final. In the event Tapatap.com's decision conflict with the decision of the Contest Creator, the decision of Tapatap.com shall govern.

Eligibility in Contests:
ALL CONTESTS ARE VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Unless otherwise provided in the Official Rules or applicable law, Contests are open to legal residents of the 50 United States and the District of Columbia who, as of the date of entry submission, have attained the age of majority in their state of residence, or are emancipated minors, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Tapatap.com Rules and the Official Rules. Employees of Tapatap.com, its affiliates, subsidiaries, Providers, advertising, promotion agencies, and their immediate families and those living in same household of each are not eligible to participate in any Contest. Unless otherwise stated in the Official Rules, you may enter a Contest as often as you like. You may also enter by mailing an entry including your photo or image and contact information to Tapatap.com.

Duration and Entry
Contests begin the moment that a Contest Creator creates the Contest by posting it on a page of the Site (the "Contest Page"). All Contests end at 11:59:59 PM Pacific Standard Time US on the date specified on the Contest Page. Contests may be designated by the Contest Creator as either "open" or "closed." For open Contests, you may submit an entry into the Contest through the Contest Page. The Contest Creator may limit the number of entries by any user into the Contest. The Contest Creator may also remove Content from the Contest, close the Contest to further Entries, or end the Contest at any time. For closed Contests, only the Contest Creator can submit entries into the Contest.

Invitations
If you are a Contest Creator or a Contestant, you are encouraged to share your Contest or Entry in the Contest with friends and family and ask them to create a free Tapatap.com account and participate in your Contest or vote for your entry. However, no Contest Creator or Contestant is permitted to send "spam," as further described in the Terms of Service. You may not create multiple accounts for the purpose of voting more than once for an entry. Noncompliance with these or any other Tapatap.com Rule or Official Rule will result in disqualification and legal action as necessary.

Submission of Entries
Any entry or comment which in the sole opinion of the Contest Creator, a Provider or Tapatap.com is deemed inappropriate (e.g., defamatory or depicts nudity, violence or inappropriate acts, inconsistent with Contest description, etc.) or which otherwise violate these Tapatap.com Rules, the Official Rules for the Contest, or the Terms of Service will be removed, and the Contestant disqualified. All submitted content must be in the language of the website where the Contest was created (e.g., Tapatap.com uses English) unless otherwise noted in the Official Rules. Entries will not be acknowledged or returned.

Users can make contest submissions from the Tapatap.com web site and mobile web site by creating a profile and uploading a digital photo in a JPG, JPEG, GIF, BMP, PNG format of less than 3.2MB to enter a Tapatap.com contest per the contest dates and specifications.

Submission of Entries into Prize Contests
Unless otherwise noted in the Official Rules, entries into contests with a monetary or non-monetary prize must be an original photograph or image.� Original photographs or images can be defined as follows:

  1. It is a photo or image of the Contestant himself/herself;
  2. It is a photo that the Contestant took or created and owns the rights to that photo; or
  3. It is artwork that the Contestant created and owns (including mash-ups)

Posting a photograph of someone else that the Contestant does not own or is not of the Contestant is prohibited.� Posting a copyrighted photograph that the Contestant does not own is also prohibited.

Tapatap.com reserves the right to remove any prohibited photographs or images from a contest at anytime and without notification.

Prize Limits

  1. Members may only win the total value of $500 of prizes per membership lifetime (includes voter, creator, and Tapatap monthly and prize contests-value of Wii, iPhone, etc).
  2. The member may win TWO 3rd party sponsored contests per membership lifetime, which will not be counted against the $500 lifetime value of prizes.
  3. These limits will be enforced on a PER HOUSEHOLD basis. For purposes of determining prize eligibility, a household is defined as one or more members living together, regardless of relationship.

    4. ***Enforced as of January 20, 2008 (prizes won June 16, 2007 to present will be calculated into the $500 value total)

Voting
In each face-off contest, users will have the opportunity to cast one vote in the affirmative for each image or photo they feel is entertaining or otherwise best meets the selection criteria, if any, in the Official Rules. In the case of a face-off contest, a user may vote for one of the two entries in each match-up. If the same user is presented with the same two entries in a face-off a second time, only their first vote will be counted in the contest. In each rating contest, users will have the opportunity to rate each image or photo one time on a scale between one and ten.� If the same user is presented with the same image or photo more than once time, only their first vote will be counted in the contest. The general voting will end on the date specified on the Contest Page, at 11:59:59 PM Pacific Standard Time U.S. On or about that same date, Tapatap.com will identify the most popular entry (in a face-off contest this is defined as the total the number of eligible vote wins minus the total number of eligible vote losses, and in a rating contest this is defined as the highest average rating) and contact the winner about the prize shortly after that date. Tapatap.com may apply a weight to votes based on a trust based scoring system that factors in voter accuracy and potential fraud.� ������

Entry Limitations
Tapatap.com reserves the right to disqualify, and delete from its system, any entry that, in its sole discretion, Tapatap.com believes: (i) is unlawful, harmful, abusive, racially or ethnically offensive, vulgar, obscene, sexually explicit or suggestive, defamatory, infringing, fraudulent, invasive of personal privacy or publicity rights, harassing, libelous, threatening, or in its view, objectionable; (ii) is an attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Site; (iii) imposes, or may impose, at our sole determination, an unreasonable or disproportionately large load on our infrastructure; (iv) contains, uses, uploads, or attempts to use or upload invalid data, bugs, errors, Trojan horses, time bombs, viruses, worms, or other software agents designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment, to the Site; (v) contains or uses any robot, spider, or scraper; (vi) results in Contestant impersonating another person or otherwise misrepresenting Contestant's affiliation with a person or entity; (vii) includes material that Contestant does not have a right to make available under any law or under contractual or fiduciary relationships; or (viii) fails to meet the entry requirements or violates the Site Terms of Service. Tapatap.com reserves the right to disqualify and prosecute to the fullest extent permitted by law, any Contestant who, in Tapatap.com's sole determination or suspicion, tampers with any of Tapatap.com's websites, the entry process, or the Contest, violates the Terms of Service, any Official Rules or these Tapatap.com Rules, or acts in a disruptive manner. In the event of disqualification of a winner in its Contests, the disqualified winner may be replaced with the next runner-up at the sole discretion of Tapatap.com., the Provider, or Contest Creator.

Prizes
Prizes, if any, shall be listed in the Official Rules along with an estimated retail price, and are provided by the Contest Creator, Tapatap.com or a Provider, to the individual identified as the submitter of the Entry that is selected as the overall winner of a Contest. The details of the prize are provided on the prizes page for each Contest.

Winners
To find out the name of the overall winner(s) of a Contest (including but not limited to Voter Tap and Creator Tap contests), visit the Prizes Page after the specified Contest end date, which will be posted within ten days of each Contest end date. Winners may be required to send a copy of their passport, driver's license and/or birth certificate as proof of age.� Overall winners may be notified by email and must provide any information requested by Tapatap.com to confirm identify and eligibility and claim their prize, and must respond within 5 business days of such email. If Tapatap.com or the Provider does not receive response with this time period, the notice is returned undeliverable, or for any other reason, the winner may be disqualified and an alternate winner will be determined by the Contest Creator. These prizes are non-transferable, non-redeemable for cash and may not be applied as a credit towards a different product. �These prizes shall not include any fees, transaction costs, taxes, governmental fees, etc., which shall be the sole responsibility of the winners. Tapatap.com reserves the right to withhold any taxes as required by applicable law. The winning Contestants may be required to supply Social Security numbers or other taxpayer identification numbers prior to the award of any prize.� Products may include terms and conditions that apply to all winners. �The fair division and distribution of prizes among co-creators of winning entries is the responsibility of the winners. All prizes will be awarded to the first and last name as provided by the Contestant.� All federal, state and local income taxes are sole responsibility of overall winners. All winners assume all liability for their use or inability to use any prize, including without limitation, any injury, damage caused or claimed to be caused by participation or use or redemption of any prize. Tapatap.com is not responsible for any prize awarded by any Provider, including for any warranty, costs, support or other services associated with the prize.

List of Winners
Winners usernames shall be posted on the Site after the winners of each Contest are selected. Tapatap.com will also provide a list of winners for a particular Contest upon request.

Indemnification and Liability Limitation
BY ENTERING THE CONTEST, EACH CONTESTANT INDEMNIFIES, RELEASES AND AGREES TO HOLD HARMLESS TAPATAP.COM ANY PROVIDERS, AND THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS (INCLUDING WITHOUT LIMITATION ATTORNEY FEES), LOSSES, OR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO THOSE RELATED TO, PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY, OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH CONTESTANT'S: (1) ENTERING THE CONTEST; (2) ACCEPTANCE OR USE OF ANY PRIZE; (3) ANY OTHER ACT OR OMISSION ARISING OUT OF OR RELATING TO THE CONTEST; OR (4) ANY PRODUCT OR COMPONENT OF THE PRODUCTS. TAPATAP.COM SHALL NOT BE LIABLE TO ANY CONTESTANT FOR USE OF THE ENTRIES.

These contest rules (the "Official Rules"), along with the set of rules posted by Tapatap, Inc to govern all contests developed by either a user or Tapatap.com ("Tapatap.com Rules"), shall govern the "27 Dresses" Photo Contest (the "Contest"). By participating in this Contest, you agree to be bound by the Terms of Service Agreement, these Official Rules, and the Tapatap Rules. Tapatap reserves the right to make changes to any part of these Official Rules and/or the Tapatap.com Rules at any time by posting revised Official Rules and/or Tapatap.com Rules on the Site(s), which shall be effective upon posting. If you create, organize, participate in, or run a Contest after such posting, you are bound by the revised Official Rules and/or Tapatap.com Rules. Therefore, you should review these Official Rules and the Tapatap.com Rules as posted on the Site(s) from time to time. Changes will be indicated by the date at the bottom of the Official Rules and the Tapatap.com Rules, respectively.

  1. PARTICIPATING IN THE CONTEST:
    Any authorized user of the Site may submit a photo or image entry ("Entry") in the Contest provided he or she satisfies the qualification rules set forth below. These persons submitting Entries are referred to as "Contestants." Tapatap, Inc is the contest creator and sponsor ("Sponsor" or alternatively "Contest Creator") for this Contest, and Twentieth Century Fox Home Entertainment LLC will provide prize(s) for the Contest ("Provider"). Provider provides prize(s) for the Contest only and is not responsible for any aspect of the Contest, including but not limited to the collection, submission or processing of entries, the administration of the Contest or the selection of winners. All Contestants consent to use of their names, likenesses and Entry materials in any manner by the Contest Creator, Tapatap.com and/or the Provider or any other Tapatap.com promotional partners for advertising and trade without further compensation, unless prohibited by law. By participating in the Contest, participants agree to be bound by the decisions of the Contest Creator, Tapatap.com or its delegate (including without limitation a Provider), which are final and binding. In the event Tapatap.com's decision conflicts with the decision of the Contest Creator, the decision of Tapatap.com shall govern.
  2. ELIGIBILITY:
    The Contest is open only to persons who, at the time of entry, are legal residents of, and are physically present in, one of the forty-eight (48) Continental United States and the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, Guam and the US Virgin Islands) and who are eighteen (18) years of age or older. Employees of Sponsor, Provider and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and their immediate family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible to participate in or win the Contest. Void where prohibited by law. All applicable federal, state and local laws apply.
  3. HOW TO ENTER:
    Begins at approximately 12:01 am Pacific Standard Time ("PST") on April 23, 2008 through 11:59pm PST on May 22, 2008 (the "Contest Period"), log on to http://www.Tapatap.com (the "Website"), click on the Contest banner, and follow the on-screen entry instructions to enter and play the 27 Dresses DVD Photo Contest. Photos should be of person in a bridesmaid, prom, wedding dress or other formal dress. All entries become the property of the Sponsor.
  4. ODDS OF WINNING:
    At the completion of the Contest Period, Tapatap.com will identify the most popular Entry as the Grand Prize winner for the Contest based on the Entry that receives the highest user voting point total during the Contest period, as well as five(5) Runner-Ups based on the five Entries with the next highest user voting point totals. Limit of one (1) prize per person. All photos are paired at random and it is possible that not every photo will be paired with all possible combinations by every user. In the event of a tie between photos, Sponsor will select the winner by evaluating each player's photo and selecting the photo that has highest overall number of total wins and the earliest date of entry. Odds of winning will depend on the number of eligible entries received during the Contest period. Sponsor's decisions are final and binding in all respects.
  5. SUBMISSION OF ENTRIES:

  9. WINNER NOTIFICATION:
    Winners ("Winners") will be named after the close of the Contest at 11:59pm PST on May 22, 2008 from among all eligible entries received during the Contest Period by employees or representatives of Sponsor, whose decisions are final and binding with respect to all matters related to the Contest. Odds of winning will depend upon the high score achieved on the 27 Dressed DVD Photo Contest. Sponsor will make two (2) attempts to contact potential winners at the e-mail address provided at the time of entry. If Sponsor is unable to reach a potential winner via email after two (2) attempts, he/she may be disqualified and an alternate may be selected. Any prize left unclaimed for more than 120 hours will be forfeited. Any forfeited prize, at Sponsor's discretion, may be awarded to an alternate winner. Potential Winners may be required to complete, sign, have notarized and return an Affidavit of Eligibility and Liability Release ("Affidavit and Release") and Publicity Release (where legal) within seven (7) days of date of attempted delivery. Noncompliance within this time period, with these Official Rules or the return of or inability to deliver any prize/prize notification may result in disqualification and, at Sponsor's discretion, and time permitting, an alternate potential winner may be randomly selected.
  10. PRIZE:
    The Grand Prize Winner will win a Nordstrom Gift Certificate valued at $1000. Five (5) Runner Ups will each receive 4 DVD releases of motion pictures, with the particular motion picture titles determined by Provider in its sole discretion (approximate retail value: $80 each). Total Approximate Retail Value of all prizes is $1400. Winner is responsible for all federal, state and local taxes. No transfer, substitution or cash redemption will be awarded in lieu of stated prize except by Sponsor or Provider who reserve the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. All prize details are at the sole discretion of the Sponsor and Provider. In the event that any prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor's and Provider's prize obligation to winner and no additional compensation will be awarded.
  11. GENERAL RULES:
    Acceptance of prize constitutes permission to the Sponsor and its designees to use winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating, entrant (i) agrees to release and hold Sponsor, Provider, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"), harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Contest or misuse, nonuse or use of any prize or any part thereof (including any travel or activity related thereto); (ii) waives all rights to claim punitive, incidental and consequential damages, attorney' fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding on all matters relating to the Contest. Released Parties are not responsible for incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual's ability to participate. Sponsor reserves the right in its sole discretion, to cancel, suspend or modify the Contest, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation. In the event this Contest is cancelled prior to the stated end date, a notice will be posted on the Site. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. "Authorized account holder" is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Released Parties are not responsible for any technical, mechanical, printing, typographical, human or other error of any kind relating to or in connection with the Contest, including, without limitation, errors which may occur in the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest.

NO WARRANTIES: Neither Sponsor nor Provider makes any warranties covering any of the prizes furnished as part of this Contest.

GOVERNING LAW:All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of any participant, Sponsor, and/or any of the Released Parties shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. If any controversy or claim arising out of or relating to the Contest, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services ("JAMS") in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof ("the JAMS Rules"). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York. The decision of the arbitrator shall be binding, final and conclusive and shall not be appealable to any court.

PRIVACY: Winners' names and contact information will be shared by Sponsors in order to contact winners for the purpose of fulfillment of prizes. Information supplied by non-winning entrants will be shared by Sponsors in accordance with their respective privacy policies, which are posted at Tapatap Privacy Policy
